Is it fair im charged with assault?

I was in a fight in a parking lot after some kid pulled in and tapped my car Accidentaly. No damage was done but he was on his phone. I got out very angry and he got out saying sorry sir, I said I'll put his phone up his a$$ and he just said ok, I said I'll knock him out and he said "ull knock me out?", I said you don't know who you are messing with, he said "well im pretty tough too", I swung at him and hit his eye, he then hit me and we went at it, im a former spec ops in military, also I weighed more and was about an inch taller at 6'2, he started choking me and I smashed his head into his car. A 5'10 slim grey haired italian american in his early 60s(report says he was born in March 1951) pulled me off telling me to stop hitting the kid and had help when two other men and a girl ran over, the wop had a baseball bat in his Honda that he brought out, he kept saying "your a bully! Get away from him now! I will do what I need to protect him", found out he was a retired nurse( and was assisting the kid until cops and emt arrived. He was Dutch descent aged 26(born 1989), looked younger, had a very pretty face, he looked like a movie star with chiseled model face structure ice blue eyes brown hair, not no more Tho). I found out he has a disability Asperger's which affects cordination and common sense. I am now being charged under a law in NY state for attacking someone with a disability. I got in his face and he got in mine. He looked like he was gonna cry.
Added (1). The judge is going extra hard on me and treating me like trailer white trash. My Fam is very american(been here since pilgrims, grew up in west virginia and Ohio). I was defending me, my car. How dare pretty skinny boy drive on a phone? I was justified he said he was tough so I wanted to see.
Added (2). Also his girlfriend is sexy she came into court and basically called me mentally unstable. Pretty sure that's her boyfriend not me
