In an auto accident, are you entitled to a rental car that is similar to the car that was damaged?
Hi, a couple of days ago my wife was rear ended on the freeway, not too bad, no one was injured.
We were contacted by the other parties insurance (Allstate) and were told that "IF" they do accept liability, that we would only receive $24/day towards a rental car. Our car that was damaged is a brand new Honda Minivan, and a week long minivan rental would be upwards for $350.
My understanding was that the at fault parties insurance had to pay for a "comparable" rental. Was I mistaken on that?
