Buying a car from BMW in Alberta?


So I went into bmw today and looked at a car that was $82000. I m trading in my old honda accord and they said they would completely buy out the loan so no negative equity would need to be buried. I m borrowing 44000 from BMW Canada Finance but am putting 50000 down from my stocks and share investments. That takes about 5-7 business days to process. The dealership told me that once an approval from the bank has been pushed through and I have an accepted approval from the bank I could take the car home without putting the 50000 down prior to delivery and that I would just need to pay them when I had the funds available as they just want the sale. My question is this; if I can t access the 50000 in funds from my stocks and I ve already taken delivery of my new vehicle and they took my old one, what would happen? On the paperwork it says that the downpayment mentioned is 50000. But total due on delivery is 0. Would I be charged with grand theft auto if I fail to make the down payment even though the paperwork says nothing was due upon delivery? Would the dealership be at fault? I m a little confused.

Basically I bought a car. Got approved for a 44000 loan but required to put down 50000 but not upon delivery. I m not giving them a check. They re willing to release it to me before me giving the down payment. What are the legal concerns I should be worried about? Who would be at fault and why?
